BC Residential Tenancy Act: What Landlords Can (and Can’t) Charge You For at Move-Out

Moving out of a rental in Vancouver comes with one big question: will you get your full damage deposit back? The answer usually comes down to cleaning, and most tenants don’t actually know what the law says about it.

Here’s what the BC Residential Tenancy Act requires, what landlords are allowed to deduct for, and how to protect your deposit.

What the law actually says

Under BC’s Residential Tenancy Act, tenants are required to leave a rental unit “reasonably clean”, not spotless, not professionally detailed, just reasonably clean given normal wear and tear. That phrase does a lot of work, and it’s where most disputes start.

A landlord can’t charge you for:

  • Normal wear and tear (faded paint, worn carpet from years of use, minor scuffs)
  • Cleaning that was already needed before you moved in and wasn’t documented
  • A deep clean standard beyond what a reasonable tenant would leave

A landlord can deduct from your deposit for:

  • Visible dirt, grease, or grime left in the kitchen or bathroom
  • Stains, odours, or damage beyond normal wear
  • Garbage or belongings left behind
  • Anything noted as a problem on your move-in condition report that’s worse at move-out

Why the move-in condition report matters

Before you even think about cleaning, dig up your move-in condition inspection report. This document is your baseline — it’s what the landlord will compare your unit against at move-out. If something was already scuffed, stained, or worn when you moved in, it shouldn’t count against you now, but only if it’s documented.

If you never did a proper move-in inspection, take photos of everything before you start packing. It’s the easiest way to prove what condition things were in.

What actually causes deposit disputes

The same handful of issues tend to cause the most trouble at move-out:

  • Oven and stovetop grease
  • Bathroom grout and tile buildup
  • Carpet stains or pet odour
  • Dust inside cabinets and behind appliances
  • Balcony or patio debris
